These Terms of Service (“Terms”) govern the provision of live entertainment services by Bana Mazembe Band (“the Band”, “we”, “us”) and the use of the website at banamazembe.com. By booking the Band or using this website, you agree to these Terms.

1. Booking and Confirmation

A booking is only confirmed once a signed agreement (or written confirmation by email) and any agreed deposit have been received by the Band. Verbal agreements or provisional reservations do not constitute a binding booking.

2. Deposit and Payment

The required deposit and payment schedule are agreed on a per-booking basis and set out in your written quotation or contract. Unless otherwise agreed in writing:

A deposit is payable to secure the date and is applied against the total performance fee.
The remaining balance is payable on or before the performance date, as specified in your contract.
Late payment may result in cancellation of the booking at the Band’s discretion.
All amounts are quoted in the currency stated on your invoice, typically Kenyan Shillings (KES).

3. Cancellations and Postponements

Cancellation and postponement terms are negotiated individually and set out in your written contract. In the absence of a written agreement, the following general principles apply:

Cancellations made with reasonable notice may be rescheduled to a mutually agreed alternative date, subject to availability.
Deposits may be non-refundable or partially refundable depending on how close to the event the cancellation occurs and on costs already incurred.
The Band reserves the right to cancel a performance in cases of force majeure (see clause 9).

4. Performance Services

The Band agrees to provide live musical entertainment as described in the booking confirmation. The client agrees to provide:

A suitable, safe performance area with adequate space and power supply
Access to the venue at least 2 hours before the performance time for setup and sound check
Any agreed refreshments, meals and changing facilities for band members
Reasonable working conditions in accordance with Kenyan law and safety standards

5. Technical Requirements

Unless otherwise agreed, the Band provides its own instruments, sound system and microphones. Where the venue or client supplies equipment, the Band is not responsible for faults, failures or incompatibility of third-party equipment.

6. Travel and Accommodation

For events outside Nairobi, travel, accommodation and per diem costs are agreed in advance and invoiced separately or included in the quoted fee. For international bookings, additional requirements (visas, work permits, flights) are coordinated with the client in good faith.

7. Recording and Media

The client may not record, stream, broadcast or commercially distribute the Band’s performance without prior written consent. The Band may photograph or record its own performances for promotional purposes and reserves all rights to such material.

8. Liability

To the fullest extent permitted by law, the Band’s total liability arising out of or in connection with a booking shall not exceed the total performance fee paid for that booking. The Band is not liable for indirect, incidental or consequential losses, including lost profits or event cancellation costs caused by circumstances beyond its reasonable control.

9. Force Majeure

Neither party is liable for failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, pandemics, government restrictions, war, civil unrest, or serious illness of key band members. In such cases, both parties will work in good faith to reschedule or reach a fair resolution.

10. Website Use

All content on this website — including text, images, logos, audio and video — is the property of Bana Mazembe Band or its licensors and is protected by copyright. You may not copy, reproduce or republish any content without prior written permission.

11. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms or a booking shall be subject to the exclusive jurisdiction of the courts of Kenya.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the latest revision. Continued use of our website or services after changes constitutes acceptance.
